3D Realms has voluntarily dropped its lawsuit against Gearbox after finding out that the accusations was unfounded and that it misunderstood the terms of Duke Nukem Foremver's partnership.
The lawsuit was filed in June this year where 3D Realms alleged that Gearbox owned them $2 million as part of a 2010 agreement regarding the Duke Nukem IP. In the suit's filing, 3D Realms claimed that Gearbox had "refused and failed to make substantial royalty payments" that were due according to the agreement.
However, the company now admits that its allegations were due to "misunderstanding."
"After reviewing evidence regarding our business affairs, and without any money exchanging hands, we have satisfactorily resolved any and all differences that we perceived against Gearbox," said 3D Realms co-founder and CEO Scott Miller.
"In all sincerity, we regret the misunderstanding that instigated our lawsuit. Now that we better understand--and appreciate--the actual nature of our business matters, we have voluntarily withdrawn our claims against Gearbox, with genuine apologies to [Gearbox president] Randy [Pitchford] for any damage that our lawsuit may have caused to the relationship."
The lawsuit has been dismissed "with prejudice," so 3D Realms is legally prohibited from ever filling for the same claim again.
