Zuffa LLC, the organization The organization behind the Ultimate Fighting Championship mixed martial arts league has filed a lawsuit against Ubisoft for copyright infringement induced by the "deliberate capitalization and bolding" of two words on the back of its recently released Kinect game Fighters Uncaged.
The phrase under dispute is "Become the ULTIMATE FIGHTING weapon," which is the slogan on the back of the game's box.
According to Zuffa's filing, the deliberate capitalization and bolding of the "ULTIMATE FIGHTING" portion of the phrase is "confusingly similar to the us of UFC Marks, including the ULTIMATE FIGHTING name and mark on Zuffa licensed video games."
Furthermore, Zuffa accuses Ubisoft of "trading on the goodwill" of the UFC brand while tarnishing it by associating its mixed martial arts tournaments with the game's illegal street fighting.
In addition to asking for "unspecified compensatory, consequential, statutory, incidental and exemplary damages," Zuffa also seeks to stop the distribution of Fighters Uncaged until and unless the Ultimate Fighting trademarks and its variations are removed.
