Zenimax, the parent company of developers like Bethesda, Arkane Studios and id Software, has threatened legal action against an indie developer for its attempt to trademark the game name: "Prey for the Gods," because it had Prey in the title. Zenimax owns the Prey trademark and believes it needs to defend it with the impending release of the Prey reboot.
The indie developer in question is NoMatter Studios, which was working on a third-person action-adventure title called, Prey for the Gods, but that game now needs to be called Praey for the Gods, because Zenimax wasn't happy with it. While the developer did consider fighting the action in court, it would have been a lengthy legal battle and one that Zenimax could bring a lot more money and legal experience too, so it decided to bow out.
While by the event and wished that an agreement could have been reached with Zenimax, ultimately it's just happy to be continuing making the game without interruption.
"This is really something no starting company should have to deal with let alone a tiny team of 3. So the fact that we came out the other end intact still developing the game was a win. One that will no doubt shape our company moving forward," it said in a statement.
This is of course, not the first time Zenimax has gone after smaller developers with legal action over their game names. Previously it targeted Mojang for its game Scrolls, which it claimed was too similar to its game series the Elder Scrolls. In that case though, Mojang had much more financial backing and fought the action, ultimately getting to keep its game name as it was.
